You agree to observe and abide by all copyright and other proprietary notices, legends, or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site.

4. User Submissions (Where Applicable)

If you submit information through forms on our Site (e.g., the contact / scoping form, newsletter subscription, career applications, or the client portal):

• You represent and warrant that you own or otherwise control all of the rights to the information that you provide, that the information is accurate, and that use of the information you supply does not violate these Terms and will not cause injury to any person or entity.
• You grant Fluxent a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such information as necessary to provide the relevant service (e.g., respond to your inquiry, process your application, deliver your engagement, send newsletters).

7. Limitation of Liability

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in New York County, New York.
